By accessing or using any services offered by Alentar Communication ("Company", "we", "us"), you ("Client", "you") agree to be bound by these Terms & Conditions and our Privacy Policy. If you do not agree, please discontinue use of our platform immediately.
Alentar Communication provides business messaging and voice communication services including Bulk SMS, RCS Messaging, WhatsApp Business API, OBD Voice Calls, IVR Solutions, and Call Center-as-a-Service. The specific services, volumes, and pricing applicable to your account are governed by your Service Agreement or purchase order.
You must be at least 18 years of age and represent a legitimate business entity to register. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. Notify us immediately of any unauthorised access at support@alentar.in.
You agree not to use our services to: send unsolicited spam or messages to recipients who have not provided consent; transmit content that is unlawful, defamatory, obscene, or fraudulent; violate TRAI DLT regulations or any applicable Indian or international law; conduct phishing, scamming, or impersonation campaigns; send messages related to illegal goods, gambling, or adult content without lawful authorisation; or cause network congestion or interfere with our platform's integrity.
We reserve the right to suspend or terminate accounts found in violation without prior notice.
Clients sending commercial SMS in India must be registered on the DLT (Distributed Ledger Technology) platform as mandated by TRAI. You are solely responsible for ensuring your sender IDs, templates, and message content are DLT-approved before submission. Alentar Communication is not liable for message failures arising from non-compliant templates or unregistered headers.
Pricing is as per your agreed rate card or our published tariffs. All amounts are in Indian Rupees (INR) and exclusive of applicable GST. Prepaid accounts require advance recharge; postpaid accounts are billed monthly with payment due within 15 days of invoice date. Late payments attract interest at 18% per annum. We reserve the right to revise pricing with 30 days' notice.
We target 99.9% platform uptime, excluding scheduled maintenance (notified 48 hours in advance) and force majeure events. Message delivery is subject to the availability and policies of telecom operators and third-party platforms (e.g., WhatsApp, Google RCS). We are not liable for delivery failures caused by operator outages, TRAI directives, or recipient-side issues.
All software, APIs, dashboards, documentation, and branding belonging to Alentar Communication are our exclusive property. You are granted a limited, non-exclusive, non-transferable licence to use our platform for the duration of your subscription. You may not reverse-engineer, resell, or sublicense our platform without written consent.
Both parties agree to maintain the confidentiality of the other's non-public business information. This obligation survives termination of the agreement for a period of 3 years.
To the maximum extent permitted by law, Alentar Communication's aggregate liability for any claims arising out of or related to these Terms shall not exceed the total fees paid by you in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including loss of business, data, or profits.
You agree to indemnify and hold Alentar Communication, its directors, employees, and partners harmless from any claims, penalties, or expenses (including legal fees) arising from your violation of these Terms, misuse of the platform, or breach of applicable laws.
Either party may terminate the agreement with 30 days' written notice. We may terminate immediately for material breach, non-payment, or illegal use. Upon termination, your access is revoked, unused prepaid balance is refunded (less processing fees), and all confidential data is deleted per our retention policy.
These Terms are governed by the laws of India. Any disputes shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in Gautam Buddh Nagar, Uttar Pradesh.
We reserve the right to update these Terms at any time. Updated Terms will be posted on our website and notified to registered clients via email with at least 14 days' notice. Continued use of the services after the effective date constitutes acceptance.
